One Cyclist Killed In Modesto Car Crash
A crash in Modesto involving a Lexus killed one cyclist on August 23, 2018.
According to The Modesto Bee, this crash happened at 9:45 PM on Highway 132 just east of Empire. Before the crash, both the cyclist and motorist were headed east on Highway 132. Allegedly, the Lexus driver rear-ended the bicyclist, which caused the crash victim to fall forward onto the ground. The Lexus driver remained on the scene of the crime.
We are deeply saddened to learn that the cyclist died from his injuries.
Police are still investigating the primary cause of this crash.
Comparative Fault In California
While we’re not certain what took place in the above-mentioned crash without investigating, it is worth mentioning comparative fault for other cyclists.
California is a comparative negligence state. Sometimes called comparative fault, this law basically means the fault for an accident can be split out of 100 percent between all contending parties.
For example, an injured bicyclist who was partially at fault for a crash can still receive a percentage of compensation. This is why it’s critically important for injured cyclists to talk with a seasoned bicycle injury lawyer before accepting whatever insurers tell you.
