Unfortunately, after a tragic accident, you can expect insurers to begin trying to get out of paying compensation and working against you and your family during one of the toughest times in your lives. That’s because they’re extremely worried about wrongful death actions for cyclists which extend far beyond funeral and burial costs.
The Mod Bee article points out that the man was not wearing a helmet and that the driver never saw the cyclist. These are some of the exact defenses an insurance company could use to attempt to not compensate a loved one. In an accident like this, there may be not one but several liable parties and the fact that no helmet was worn may be completely irrelevant to an injury case or a wrongful death claim. For example, in California, helmets are only required for children under the age of 18. We’ve represented cyclists not wearing a helmet before.
